Raceforce Global - Terms of Service

Welcome to Raceforce Global. These Terms of Service ("Terms") govern your use of our Platform, including our website, job board, and any related services (collectively, the "Service"). By accessing or using the Service, you agree to comply with these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old to use our Service. By using the Service, you represent that you have the legal capacity to enter into these Terms.

2. User Accounts

As a User, you must create an account to access certain features. You are responsible for maintaining the security of your account and password. You must provide accurate and up-to-date information. Raceforce Global reserves the right to suspend or terminate accounts for any misuse or violation of these Terms.

3. Job Listings

As a User, you may have the ability to post job listings on the Platform. You agree that all job listings you post will be accurate, lawful, and comply with applicable laws and regulations. You are solely responsible for the content of your job listings and any consequences arising from posting inaccurate or misleading information.

4. Job Applications

As a User applying for jobs through the Platform, you agree to provide accurate and truthful information in your application materials. Raceforce Global is not responsible for the hiring decisions of employers using the Platform. We do not guarantee the accuracy or authenticity of job listings, and we encourage Users to exercise caution and conduct their own due diligence.

5. User Content

The Platform may allow you to post, submit, or upload content, including but not limited to resumes, cover letters, and job listings ("User Content"). You retain ownership of your User Content, but by providing it to us, you grant Raceforce Global a worldwide, non-exclusive, royalty-free, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Platform's operation and promotion.

6. Prohibited Activities

You agree not to use the Platform for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Platform's functionality. You also agree not to engage in any of the following prohibited activities:

  • Use the Platform to post false, misleading, or fraudulent information.
  • Use the Platform for unauthorized commercial activities.
  • Harass, intimidate, threaten, or engage in discriminatory behavior towards other Users or Raceforce Global personnel.
  • Attempt to gain unauthorized access to the Platform or other Users' accounts.
  • Use automated means, including bots, spiders, or scrapers, to access the Platform or collect User information.
  • Upload viruses, malware, or any other harmful content.
  • Violate any applicable laws, regulations, or third-party rights.

7. Intellectual Property

Raceforce Global owns all intellectual property rights in the platform, including branding, design, and content. Users may not reproduce, distribute, or create derivative works from our content without permission.

8. Data Protection and Privacy

Your privacy is important to us. Raceforce Global complies with the General Data Protection Regulation (GDPR) and Dutch privacy laws. Users' personal data is collected, stored, and processed in accordance with our Privacy Policy. Users have the right to access, correct, or delete their personal data as required by GDPR.

8. Modifications to the Platform

Raceforce Global reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice. We may also impose limits on certain features or restrict your access to parts or all of the Platform without liability or notice.

9. Indemnification

Users agree to indemnify, defend, and hold harmless Raceforce Global, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the platform in violation of these Terms.
  • Any User content including job posting, job application, or communication made through the platform.
  • Breach of any applicable laws, including Dutch labor and data protection regulations.

10. Disclaimers and Limitation of Liability

Raceforce Global provides the Service "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising of or in connection with the use of the platform even if we have been advised of the possibility of such damages. This includes job hiring decisions or disputes. Users assume all risks associated with using the platform.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflicts of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in The Netherlands.

12. Changes to the Terms

Raceforce Global may update these Terms periodically. Any changes will be posted on this page, and the "Effective Date" at the top will reflect the most recent revision. Your continued use of the Platform after the revised Terms are posted constitutes your acceptance of the changes.
